What to Do When Your Rights Are Violated
🛡️ If Your SSF Rights Are Violated
Steps:
- Ask your employer/HR in writing to enroll you. Keep a copy.
- If no action within 7 days, file complaint at SSF Head Office: Naxal, Bhagwati Marg, Kathmandu
- Email: info@ssf.gov.np with your employment details
- Call toll-free: 1116 (NTC) or 1660-01-55555
- Also complain to your district Labour Office — non-registration violates Labour Act 2074 as well
Penalty for employer: NPR 1,00,000 fine OR 1-year imprisonment OR both. Source: Social Security Act 2074, Section 71
This is a criminal offence (breach of trust).
- Log in at sosys.ssf.gov.np — check your contribution history. Missing months confirm the problem.
- Take screenshots as evidence.
- File a police complaint (this is a criminal matter — breach of trust under Section 71)
- Simultaneously file complaint at SSF and district Labour Office
- Consider engaging a labour lawyer

- Get the denial reason in writing from SSF
- Gather all evidence: accident report, medical bills, witness statements, employer notification
- File a formal appeal with SSF Board
- If appeal fails: petition the Administrative Court or Labour Court
- Contact National Human Rights Commission if your rights are being systematically denied
⚖️ If Your Labour Act Rights Are Violated
- Request leave in writing (email or letter). Keep a copy.
- If denied, escalate to HR head in writing, citing Labour Act 2074, Section 41/43
- File complaint at district Labour Office (Shram Karyalaya)
- The Labour Inspector will investigate and can order leave payment

- Calculate correct overtime: 1.5x hourly rate (first hour) then 2x (remaining)
- Document all overtime hours worked (time in/out, emails, etc.)
- Request correct payment in writing from employer
- File complaint at district Labour Office with evidence

- Get the termination reason in writing
- If dismissed for union activity, pregnancy, filing a complaint, or discriminatory reasons — this is illegal
- File complaint at district Labour Office within 35 days of dismissal (time limit important)
- Labour Court can order reinstatement or up to 6 months compensation

Your SSF Rights (Social Security Act 2074)
- Mandatory enrollment within 3 months of hiring
- Accident coverage from Day 1 — no exceptions
- Medical coverage (OPD + IPD) after 3 months
- 98-day maternity leave after 12 months
- Retirement Fund withdrawable on any job termination
- SSFID is yours for life — portable across employers
- Right to verify contributions at sosys.ssf.gov.np
- Criminal complaint if employer deducts but doesn't deposit
Your Labour Act Rights (Labour Act 2074)
- 12 working days annual leave per year
- 12 days sick leave per year
- 98 days maternity leave (60 paid by employer)
- 15 days paternity leave
- Overtime at 1.5x (first hour) then 2x
- Maximum 4 hours overtime per day, 20 per week
- 30 days notice before termination OR 1 month salary
- No termination during pregnancy/maternity leave
- Right to form and join trade unions
- Minimum wage must be paid (verify at moless.gov.np)

What Your Employer CANNOT Do
- Refuse to enroll you in SSF (criminal)
- Deduct SSF but not deposit it (criminal)
- Set basic salary below 60% of gross (illegal)
- Force excessive overtime beyond legal limits
- Dismiss you for union membership (illegal)
- Pay below minimum wage
- Discriminate in pay or promotion based on gender, caste, religion
- Dismiss you during maternity leave
