❌ No — not yet eligibleMaternity benefits require 12 months of SSF contributions within the previous 18 months. Priya has 5 months — she needs 7 more months before she can claim SSF maternity benefits. She IS still entitled to 98 days maternity leave under Labour Act 2074.
📖 Ramesh's Employer — "Ramesh's employer hasn't deposited SSF for 3 months. He breaks his arm at work. Who pays for his treatment?"
⚠️ The employer pays personallyUnder the July 2025 amendment (Section 9(6) of Social Security Act 2074), if contributions were not deposited and the employee suffers a work accident, the employer is personally liable for the full SSF-equivalent benefit from their own funds. SSF will not cover this gap.
📖 Bikash's Accident — "Bikash has a motorbike accident (non-work). His personal insurance paid NPR 3L. Total medical bill: NPR 6L. How much does SSF cover?"
✅ SSF covers NPR 4,00,000SSF covers up to NPR 7L for non-workplace accidents, minus what other insurance already paid (NPR 3L deducted). So SSF covers: NPR 7L − NPR 3L = NPR 4L. Total paid: NPR 3L (insurance) + NPR 4L (SSF) = NPR 7L — full bill covered.
📖 Sita's Pension — "Sita contributed to SSF for 10 years (120 months) and just turned 60. Can she claim a monthly pension?"
❌ No monthly pension — but she gets a lump sumMonthly pension requires minimum 180 months (15 years) of contributions AND age 60. Sita has 120 months — 60 months short. She receives her Retirement Fund as a lump sum instead of a monthly pension.
📖 Deepak's Loan — "Deepak has been contributing to SSF for 2.5 years (30 months) and wants a housing loan against his Retirement Fund. Is he eligible?"
❌ Not yet — 6 more months neededSSF loans require a minimum of 36 consecutive months (3 years) of contributions. Deepak has 30 months — he needs 6 more months before he can apply for a housing loan.
📖 Rajan's Salary — "Rajan's gross salary is NPR 2,00,000 and his employer says his basic is NPR 60,000 (30%). Is this legal?"
❌ Illegal — his basic should be at least NPR 1,20,000Labour Regulations Rule 66 requires minimum 60% of gross salary to be classified as basic salary. 60% of NPR 2,00,000 = NPR 1,20,000. His employer is artificially suppressing basic salary to reduce their 20% SSF contribution. Rajan should demand correction in writing.
